Nevada Supreme Court Rule Changes (ADKTs)

 

ADKT 0496: The Supreme Court of Nevada has amended Justice Court Rule of Civil Procedure 3 and Rule 103.  These amendments are effective 30 days from the date of the order, which was issued June 19, 2014.  

ADKT 0476: The Supreme Court has amended two financial disclosure forms, the General Financial Disclosure form and the Detailed Financial Disclosure Form.  Amendments to these forms are effective as of July 1, 2014. 

ADKT 0497The State bar of Nevada petitioned the Nevada Supreme Court to amend Supreme Court Rule 49.9, pertaining to limited practice for certain state public defenders in rural counties.  The bar requested that the court expand limited practice granted to attorneys admitted to practice of law in other jurisdiction to those attorneys who become employed by rural county public defenders.  

ADKT 0435: On May 27, 2014, the Nevada Supreme Court appointed 14 people to the Advisory Committee on the Foreclosure Mediation Program.  Appointments are effective as of May 31, 2014. 

ADKT 0486: On May 9, 2014, the Supreme Court of Nevada issued an order officially amending Nevada Rule of Appellate Procedure (NRAP) 14, regarding docketing statements.  The Amendments are effective 30 days from the date of the order.

ADKT 0495: On May 8, 2914, the Nevada Supreme Court issued an order extending the time frame for written comments in regard to a proposed amendment to Rule of Professional Conduct 1.2, which pertains to medical marijuana. The Board of Governors of the State Bar of Nevada had originally filed a petition to amend RPC 1.2 in March; a public hearing was held on the matter and one day after the hearing the court entered an order adopting Comment 1 to the rule.  The court would like further input to address whether further action or additional rule changes might require further amendemtns or comments to RPC 1.2  As such, the written comment period has been extended to May 30, 2014.   

ADKT 0479: On April 29, 2014, the Nevada Supreme Court formally announced public hearings would be held regarding ADKT 0479, which petitions the court to amend SCR 216, regarding client interest bearing trust accounts. The public hearing will be held at the Nevada Supreme Court Courtroom in Las Vegas (with a simulcast to Carson City), on Thursday, June 5 at 3 p.m.  The court also welcomes written comments prior to the hearing; all written comments are due by 5 p.m. on May 30.

ADKT 0410: On March 21, 2014, the Nevada Supreme Court granted an order adding additional members to the committee on the preservation, access and sealing of court records.  Five additional/replacement members were added to the committee. 

ADKT 0490: On March 20, 2014, the Nevada Supreme Court adopted rules for the Justice Court of the North Las Vegas Township.  All rules are effective 30 days from the date of the order. 

ADKT 0478: On March 20, 2014, the Nevada Supreme Court Amended Supreme Court Rule 210 regarding minimum continuing legal education (CLE) requirements; the amendment clarifies the new requirement regarding alcohol abuse and mental health CLEs. The amendments are effective 30 days from the date of the order.   

ADKT 0493: On March 5, 2014 the Nevad Spreme Court amended Nevada Rules of Professional Conduct (NRCPs) 1.6, 1.18 and 4.4, which pertain to duties to prospective clients.  The amendments are effective 30 days from the date of the order. 

ADKT 0492: On March 5, 2014, the Nevada Supreme Court amended Supeme Court Rule 73 regarding attorney oaths given upon admission to the bar.  The amendments are effective 30 days from the date of the order. 

ADKT 0447: On March 3, 2014, the Nevada Supreme Court scheduled a hearing regarding amendemtns to short trial rules for private jury trials.  The public hearing will be held on Thursday, June 5 at 3 p.m. in the Nevada Supreme Court Courtroom at 200 Lewis Ave., Las Vegas; the hearing will also be simulcast to the Nevada Supreme Court Courtroom located in Cason City, located at 201 S. Carson Street.  The court also invites written comments to be submitted.  The guidelines for submitting said comments are included in the ADKT.  The deadline for submissions is May 30, 2014. 

ADKT 0488: On March 3, 2014, the Nevada Supreme Court scheduled a public hearing regarding amendments to Supreme Court Rule 58(e). The public hearing is scheduled for Thursday, May 18, 2014 at 1:40 p.m.  The hearing will be held at the Nevada Supreme Court Courtroom located at 200 Lewis Ave., Las Vegas, with a video simulcast at the Nevada Supreme Court Courtroom located in Carson City at 201 S. Carson Street.  The court also invites written comments to be submitted.  The guidelines for submitting said comments are included in the ADKT.  The deadline for submissions is May 2, 2014.

ADKT 0435: On February 25 2014, the Nevada Supreme Court adopted rules regarding the Foreclosure Mediation Program; the adopted rules are effective as of April 1, 2014.

ADKT 0487: On February 25, 2014, the Nevada Supreme Court Amended Nevada Rules of Civil Procedure 30.  The amendment to the rule is effective as of May 1, 2014. 

ADKT 0464: On February 11, 2014, the Nevada Supreme Court issued an order amending rules 98, 121.1 and 214 regarding the Transitioning Into Practice (TIP) Program.  The TIP pilot program was established in 2011 and in 2013 the court made TIP permenant.  The amendments to the rules stated above are effective 30 days from the date of the order. 

ADKT 0447: On December 6, 2013 the Nevada Supreme Court extended the alternate trial pilot program end date from December 31, 2013 to  December 31, 2014.  

ADKT 0478: On November 14, 2013, the Nevada Supreme Court issued an order scheduling a public hearing regarding Supreme Court Rule 210, which govern continuing legal education requirements; the hearing is regarding clarification to amendments made to the rule, and specifically the addition of substance abuse, addiction and mental health requirements.  The hearing will be held on Thursday, December 5 at 1:30 p.m. at the Supreme Court Courtroom at the Regional Justice Center in Las Vegas; the hearing will be videoconferenced to the Supreme Court Courtroom in Cason City as well.  

ADKT 0410: On July 22, 2013, the Nevada Supreme Court issued an order regarding the Committee on the Preservation, Access and Sealing of Court records and new policies as to how filed, lodged and presumably confidential records are to be handled at the municipal, justice and district court levels.  The order goes into effect 30 days from the date of the order.  

ADKT 0489: On July 18, 2013 the Nevada Supreme Court issued an order amending Supreme Court Rules 52, 53, 55, 56 and Addendum 1, all of which discuss bar exam applicants.  The rule changes go into effect 30 days from the date of the order.  

ADKT 0411: On July 8, 2013 the Nevada Supreme Court issued an order adding 14 members to the rural issues subcommittee of the Indigent Defense Commission.  The subcommittee members reside mostly in rural areas and Northern Nevada and are a mix of judges and attorneys.  

ADKT 0482: On April 18, 2013 the Nevada Supreme Court issued an order amending Supreme Court Rules 52 and 54 as well as Addendum 1.  The original order contained a clerical error.  Click here to see the correction made to the section of Exhibit A concerning Rule 54.  

ADKT 0483: Order requesting written comments regarding proposed amendments to Supreme Court Rule 15 (pertaining to the Commission on Access to Justice). All written comments are due to the Supreme Court Clerk's Office no later than 5 p.m. on Friday, May 31, 2013.  

On June 7, 2013, the Supreme Court issued an order amending Supreme Court Rule 15, adding representatives to the Commission on Access to Justice.  The rule change is effective 30 days from the date of the order. 

ADKT 0484: Order requesting written comments regarding proposed amendments to Supreme Court Rules 103, 105, 105.5, 113 and 116, which pertain to the appointment of members to the disciplinary hearing panel.  All written comments are due to the Supreme Court Clerk's Office no later than 5 p.m. on Friday, May 31, 2013.  

On June 7, 2013, the Supreme Court issued an order amending Supreme Court Rules 103, 105.5, 113 and 116.  The rule change is effective 30 days from the date of the order. 

ADKT 0485: Order requesting written comments regarding proposed amendments to Nevada Rule of Appellate Procdure 26. All written comments are due to the Supreme Court Clerk's Office no later than 5 p.m. on Friday, May 31, 2013.  

On June 7, 2013, the Supreme Court issued an order amending Nevada Rule of Appellate Procedure 26, regarding the computation of time.  The rule change is effective 30 days from the date of the order. 

ADKT 0486: Order scheduling a public hearing on proposed amendments to Nevada Rule of Appellate Procedure 14, which pertains to docketing statements.  The public hearing will be held on Thursday, June 6, 2013 at 3 p.m. at the Las Vegas Supreme Court Courtroom, located at 200 Lewis Avenue, 17th Floor.  The hearing will also be videoconferenced to the Supreme Court Courtroom in Carson City, located at 201 South Carson Street.   

ADKT 0487Order scheduling a public hearing on proposed amendments to Nevada Rules of Professional Conduct 26, 30 and 34, which seek to change the scope of discovery.  The public hearing will be held on Thursday, June 6, 2013 at 3 p.m. at the Las Vegas Supreme Court Courtroom, located at 200 Lewis Avenue, 17th Floor.  The hearing will also be videoconferenced to the Supreme Court Courtroom in Carson City, located at 201 South Carson Street. Written comments are due to the clerk of the court no later than 5 p.m. on Friday, May 31, 2013.  

ADKT 0449:  Order amending District Court Rule 18, pertaining to trial, hearing of cause, proceeding, motion entered into by one judge prevents action by another judge unless requested; only judge having charge of cause may grant further time to plead, act, unless his inability shown by affidavit; modification of rule in judicial districts having more than one judge, another judge requested, or another judge assigned. The order was issued on March 26, 2013 and amendments are effective 30 days from the date of the order.    

ADKT 478: Order scheduling a public hearing on Monday, November 5, 2012 at 3 p.m. to discuss amending Nevada Supreme Court Rule 210 regarding CLE requirements, and specifically whether CLEs regarding substance abuse, addictive disorders and or mental health issues should be made mandatory. Written comments are due to the Nevada Supreme Court Clerk of Court no later than Thursday, November 1 at 5 p.m.   

On January 10, 2013, the Nevada Supreme Court issued an order officially amending SCR 210 regarding the minimum requirements for continuing legal education courses. This order is effective as of February 10, 2013. 

ADKT 0435:  Order scheduling a public hearing on July 9, 2012 to discuss amending Assembly Bill 149, which pertains to the adoption of the rules for  foreclosure and mediation. Comments are due no later than Tuesday, July 3, 2012 at 5 p.m. Another order issued May 23, 2012, established an Advisory Committee for the Foreclosure Mediation Program. 

An additional order issued on July 19, 2012, reappointed mediators to the Supreme Court's Foreclosure Mediation Program. 

On December 6, 2012, the Supreme Court officially amended the rules regarding the Foreclosure Mediation Program via an order.  The amendments included the adoption of a mediator code of conduct and are effective as of January 1, 2013. 

ADKT 0424:Order scheduling a public hearing on July 9, 2012 to discuss proposed new rules under Part IX of the Supreme Court Rules governing telephonic and audiovisual participation in Nevada Courts.  Written comments are due to the court no later than Tuesday, July 3 at 5 p.m.

An order was issued on October 17, 2012, implementing new rules regarding telephonic and audiovisual particpation in Nevada Courts.  Read the Order. The new rules are effective as of January 1, 2013.  

On May 28, 2013, the Supreme Court issued an order adopting Part IX-B of the Supreme Court Rules.  This additional rule pertains to governing rules for telephonic and audiovisual participation in civil, criminal and family law cases.  This order is effective as of July 1, 2013.  

ADKT 481: Order amending Supreme Court Rules (SCR) 7.5, 8 and 9 regarding judicial councils and creating SCR 9.5 regarding listings of vexatious litigants.  The amendments and additional rule are effective as of December 13, 2012. 

ADKT 477: Order amending Supreme Court Rule 52(1), which now has provisions for military spouses.  These rule changes are effective as of December 13, 2012. 

ADKT 480: Order amending Supreme Court Rules 51(f) and 51(2) regarding applicant admissions.  These rule changes are effective as of December 13, 2012. 

ADKT 0445: Order amending Rules of Professional Conduct (RPC) 7.2, 7.2A and 7.3, which pertain to lawyer advertising, filing requirements for advertising and communications with perspective clients. These rule changes are effective as of December 13, 2012.

ADKT 479: Order scheduling a public hearing on Monday, November 5, 2012 at 3:00 p.m. to discuss amending Nevada Supreme Court Rule (SCR) 216, which discusses the creation of client interest-bearing trust accounts and the creation of a foundation to provide legally-related services to the less fortunate. Written comments are due to the Nevada Supreme Court Clerk of Court no later than Thursday, November 1 at 5 p.m. 

On November 29, 2012, the Nevada Supreme Court issued an order officially amending SCR 216 and thus amending the rules regarding client interest-bearing trust accounts and the foundation responsible for administering such accounts. This order is effective as of December 29, 2012. 

ADKT 447: On October 31, 2012, the Nevada Supreme Court issued an order extending the alternate trial pilot program that allowed for short-trial rules to provide for private jury trials. The order extended the pilot program, allowing it to run through December 31, 2013.   

ADKT 0472: This order amends NRCP 16.1(a)(2) regarding mandatory pretrial discovery requirements.  This order is effective 10/01/2012. 

ADKT: 0476: This order amends NRCP 16.2 and creates NRCP 16.205; NRCP 16.2 discusses mandatory prejudgment discovery requirements for domestic relations matters and the newly created NRCP 16.2 discusses mandatory prejudgment discovery requirements in paternity or custody matters.  This order is effective 10/01/2012. 

ADKT 0410: Order scheduling a public hearing on Tuesday, September 18, 2012 at 3 p.m. to discuss a draft policy on how Nevada courts should handle filed, lodged and presumptively confidential documents.  Written comments are due to the Nevada Supreme Court no later than Friday, September 14 at 5 p.m.

ADKT 0475: Order adopting uniform rules of the court for rural justice courts of Nevada.  On June 11, 2012, the Nevada Supreme Court formally adopted proposed uniform rules for rural Nevada Justice Courts. Effective 06/11/2012. 

ADKT 0476: Order scheduling public hearing regarding the possible amendment of NRCP rules 16.2, 16.21 and 16.3. Hearing date: 06/04/2012, 3 p.m.

ADKT 0473: Order adopting rules for the Tenth Judicial District Court. Effective 5/18/2012.

ADKT 0474: Order amending Eighth Judicial District Court rule 5.42, regarding departmental assignment procedure. Effective 5/18/2012.

ADKT 0453: Order amending Supreme Court Rule 86.5 regarding the Clients' Security Fund. Effective 3/7/2012.

ADKT 0310: Order amending the Nevada Short Trial rules related to authority, trial de novo cases, time for filing demands of removal, size of jury, fees and more. Effective 3/7/2012.

ADKT 0469: Order amending the rules of the Eighth Judicial District Court, including rules 1.90 (caseflow management), 2.14 (Judicial Peview Petitions for the Foreclosure Mediation Program), 2.34 (discovery disputes), 2.90 (dismissal for lack of prosecution) and 7.80 (court intepreters); and adopting rule 2.91 (voluntary dismissal processing). Effective 01/14/2012.
