5/01 New IOLTA Program Rules Effective May 1

Don't forget that on May 1, 2008, the new rules concerning the Interest on Lawyers Trust Accounts program (IOLTA) go into effect.  The Nevada Supreme Court changed SCR 217, converting the Interest on Lawyers Trust Accounts program (IOLTA) from an “opt-out” program to a comprehensive program in which all Nevada attorneys with trust accounts must participate. Interest accrued on all nominal, short-term client funds will be automatically transferred to a foundation for distribution to legal services agencies. This will help Nevada’s low-income population gain access to the courts, and assist victims of domestic violence and children protected or in need of protection by the juvenile court.

Supreme Court Approves Major Changes To Lawyer Advertising Rules

The Nevada Supreme Court has approved major changes to the rules governing lawyer advertising to ensure that ads are accurate and would-be clients are not misled.

The new rules, approved unanimously by the seven justices, also provide an enhanced enforcement system through the State Bar of Nevada.

"Citizens often choose lawyers based solely on their advertisements," said Justice James Hardesty, who helped get the new rules passed. "Because choosing a lawyer can be such an important decision, we want our citizens to have accurate and complete information."
